About this deal

The Health and Safety (Safety Signs and Signals) Regulations 1996 (the Safety Signs Regulations) implement European Council Directive 92/58/EEC on minimum requirements for the provision of safety signs at work. This guidance is aimed at helping employers meet their responsibilities under these Regulations. Summary Regulations relating to smoking in company vehicles came into force on 1 July 2007. The Regulations require employers to use a safety sign where there is a significant risk to health and safety that has not been avoided or controlled by the methods required under other relevant law, provided use of a sign can help reduce the risk. Safety signs are not a substitute for those other methods of controlling risks such as engineering controls and safe systems of work. they define 'private vehicles', which are exempt, as 'any car which is not a public transportation vehicle... and any other vehicle used primarily for private purposes'. Apart from displaying the required symbol for no smoking, employers must ensure that no one smokes in or on a premises or vehicle. Failure to do this can result in heavy financial penalties. They apply to all workplaces and to all activities where people are employed, but exclude signs used in connection with transport or the supply and marketing of dangerous substances, products and equipment. Since 1 October 2012, at least 1 legible no-smoking sign must still be displayed but owners and managers are now free to decide the size, design and location of the signs.a company car used solely by one employee and not used by anyone else for work either as a driver or passenger is exempt and does not need to be smoke free; enclosed vehicles which one or more persons use for work will be no-smoking premises and covered by the ban. The ban applies to cars, vans and lorries at all times if they can be used by one or more persons, as driver or passenger, in the course of paid or voluntary work – regardless of whether they are in the vehicle at the same time; a vehicle is not used at work if it is used primarily for the private purposes of a person who owns it or has a right to use it which is not restricted to a particular journey. Most people are now familiar with the law and around 8 in 10 people support it, so detailed regulations on no-smoking signs are no longer needed.
